Terms of Use

Site general conditions of use

The present document states the general conditions for the registration and the consequent possibility to utilize the services offered on the Magazine's website www.wsimagazine.com on the one hand (that is “the site”) and on the other the users (that is “the user).

The user accepts the following General Conditions of the website:

1. Property, Site Content, Copyright and Trademarks

The site and its contents, such as trademarks, logo, icon, scripts, etc., are the exclusive property of Wall Street International d.o.o. Budva (that is “the company”), with the registered office in Budva (Montenegro), or from third parties that provide services to the company. They are protected by the Montenegrin and international copyright laws. The site and all its contents will not be, entirely or partially, copied, distributed, sold, transferred or modified. The site and the products’ names, services, graphics and logos are the company’s trademarks. Other products, services, cited companies’ names could be the respective owners trademarks. The site could have links to sites not managed by the company, which are provided as simple references and for the contents the company cannot be held liable. The company does not provide any guarantee and it declines any responsibility in relation to the same. If the user decides to consult them he or she will do so at his or her own risk.

2. Description of the services offered on the site

On the site, the user has the chance to subscribe to the newsletter, to receive via e-mail general information, about marketing and promotional advertising about culture and others. Furthermore the user, whether it is a natural or legal person, operating for personal or professional purposes, has the possibility to upload articles, comments and reviews, as well as the professional activity.

3. Industrial and intellectual property rights

All the site’s contents are protected by current norms regarding copyrights and industrial and/or intellectual property rights. By way of example, the Company refers to site contents, among others:

  • the texts
  • the photographs
  • the videos
  • databases
  • graphs and tables
  • slogans
  • audio reproductions
  • cartoons animated or not
  • any graphic and/or text

It is not therefore possible to copy and/or entirely or partially reproduce the content of the site without the authorization of Wall Street International d.o.o. Budva. Be noted, that all the trademarks, domain names, social names, companies and signs present on the site are in the ownership of companies that are part of Wall Street International d.o.o. Budva and therefore protected by the current legislation about trademarks. It is therefore absolutely forbidden the reproduction of them in any way without the authorization of Wall Street International d.o.o. Budva, as well as it is forbidden to record the name Wall Street International d.o.o. Budva under any top level domain. In addition, in the site there could be marks, domain names, social names, companies and signs owned by third parties, with which Wall Street International d.o.o. Budva and/or a company with which Wall Street International d.o.o. Budva has a relationship of any kind, which benefit the same protection given to the trademarks of Wall Street International d.o.o. Budva by the current legislation. Lastly, Wall Street International d.o.o. Budva announces that it is absolutely forbidden the use of all Wall Street International d.o.o. Budva trademarks as html markup commands that although they do not require to display or to format of a specific command they supply in any case instructions to the electronic agents or to the search engines to increase the availability of a site different from those related to Wall Street International d.o.o. Budva.

4. Service features

Wall Street International d.o.o. Budva, while utilizing all the newest and advanced technological solutions to ensure the site is constantly accessible and without errors of any kind, informs that the site might not be available and/or compatible with the systems utilized to access the site, or error free, viruses and/or further system failures. Consequently, anyone who access the site understands and accepts that the site will be available “on as available basis”.

5. Linking and Framing

Without Wall Street International d.o.o. Budva written authorization, it is not in any way allowed to create links to the site first page currently accessible through the web adress www.wsimagazine.com or to any other page. If, however, there is an interest to create a link to the Homepage on your own site, it is necessary to send a request via e-mail to info@wsimagazine.com in which the following must be addressed:

  • data on the person responsible of the site technical management where the link to the Home Page will be inserted (including the e-mail address and the phone number);
  • data of the requesting company;
  • the indication of the website address where the link will be created;
  • any additional information useful to obtain the authorization from Wall Street International d.o.o. Budva.

It is expressly prohibited specific links that transfer users directly to an internal page without having to go through the Home Page first (“deep linking”), as well as automatic links (“inline linking”) that allow users to automatically visualize into a specific place images from the site. Link-box are also prohibited ("framing"), which allow a page from the site to appear into a specific page that belongs to a different site so that the content of this page will appear inside a frame structured for this purpose instead of a standalone browser window navigation. In this regard, violating what is provided in this article represents an illegal conduct and it is prosecutable in terms of unfair competition, governed by the current laws.

6. Material sent to Wall Street International d.o.o. Budva

Sending via e-mail or through the site, any kind of material to Wall Street International d.o.o. Budva will give implied consent for the material to be reproduced, used, disclosed, showed, transformed, utilized to make copies and to be distributed to third parties without any restrictions. Similarly, with the understanding of the author moral right, all the texts, the ideas, the concepts, the know-how and/or the techncal knowledge contained in the material may be economically utilized and used by Wall Street International d.o.o. Budva for any purpose, by way of example, the development, the production and marketing of products that utilize the material connected to it. By sending material to Wall Street International d.o.o. Budva the user declares and guarantees to be the exclusive owner, or to have obtained the right to use the material with consequent total exclusion that its utilization could cause violation of rights of any kind to third parties. Given the nature of “open” Internet Network, Wall Street International d.o.o. Budva suggests not to transmit through communication telematics channels material not usable by third parties.

7. Site usage

The site cannot be used in any way to send pornographic material, or that in any case may offend common decency, or, more in general, for illegal purposes. It is forbidden the reproduction, editing, duplication, the copy, the distribution, the sale or the site exploitation for commercial purposes. It is acceptable to download or print a copy of the materials in the site for personal use and non-speculative purposes. The unauthorized use of the site and the material within constitutes a violation of applicable laws on intellectual property. The user agrees to save all the information about trademarks and copyright included in the downloaded or copied materials. The utilization of these materials on any other website is forbidden.

8. Access to the site from abroad

Anyone who accesses the site from a country other than Montenegro must respect the conditions and the laws carriedd in Montenegro and has to guarantee that he or she will not utilize the site and the material contained herein in such a way that would violate the Montenegrin laws.

9. Age and responsibility of the user

The user has to be of legal age and endowed with the ability to operate necessary to utilize the site accepting the current General Conditions and to assume any responsibility arising from using the site. The registered user is obliged to indicate his or her own personal information and to guarantee that they are true, correct and up to date. The user acknowledges to be responsible for any use of the website by him or her or someone using his or her personal information.

10. Users contributions

By registering the user accepts that sending a contribution to the site makes the latter owner of the received material; the company shall have the right to alter, amend, supplement or delete any part of it. The company also reserves the right to use the user’s contribution as desired, including the possible publication of the contribution on other Internet sites, magazines, radio and/or television.

11. Acknowledgement of the site use

By accessing the site, the user agrees to abide to the following conditions:

  • agree to link to this Site only through the “Home Page”;
  • agree not to reproduce pages and frames within the Site;
  • agree not to exploit the name of the Site and/or the Company;
  • agree not to reproduce materials or links on this Site for commercial purposes.

In particular the user agrees not to:

  • transmit via mail or through telematic channels information on the Site that may be offensive, defamatory or deemed illegal;
  • use the Site in a manner that may cause harm or infringe the rights of others;
  • use software and programs that may damage the Site;
  • change, alter the overall vision of the Site or programs;
  • infringe the copyrights of third parties;
  • reproduce, copy, distribute and/or publish the contributions posted on the Site in other online publications and/or printed.

In the event that the Company believes – with discretion – that a user has breached the obligations imposed by these general conditions, the Company shall, without incurring any liability to the User Agreement:

  • delete the user registration data from the Site;
  • eliminate the contributions entered into the Site by the user;
  • start all procedural actions that are necessary to restore the rule of law and obtain compensation for damage suffered.

12. Suspension of service

The Company may suspend the service in case of extraordinary maintenance works for the time necessary to restore the Site. The Company is not liable for any direct and/or indirect damage suffered by the user due to suspension of the Website, resulting from necessary intervention or structural needs, organizational or system maintenance.

13. Changes to the website

To constantly improve the services offered, the Company may make changes to the Services, text and/or, in general, the materials within the Site. Where necessary, the Company may also make changes to the General Conditions. These changes will take effect after publication on the Site and the User may accept the new rules at that time.

14. Links to other websites

The Site may contain links to sites not operated by the Company. Such links are provided as a reference. The Company does not control these sites and therefore is not in any way responsible for their content. It is not allowed to create links of this Site or pages of other sites.

15. Limitation and indemnity

In no event shall the Company be held responsible directly or indirectly for any loss or damage of any kind that may arise from the use of this Site. The Company has the right to refuse publication of Contributions which, in its sole discretion, considers:

  • be in conflict with the law;
  • be prejudicial to the rights of third parties (by way of example copyrights);
  • detrimental to the image and reputation of the Site;
  • not in accordance with the Company’s editorial choices.

The Company declines any responsibility for damages that may be charged by the user for non-publication or for errors and omissions in comments published on the Site.

16. Exclusion of warranties and limitation of liability

The Company and its suppliers make no warranties as to the operation of the Site, accuracy, completeness, reliability of the information, materials and products it contains and reserves the right to modify and update such information without prior notice. To the extent permitted by applicable laws, the Company makes no expressed or implied warranties of merchantability and suitability for a particular purpose. Wall Street International d.o.o. Budva will not be held responsible for any damage, direct or indirect, including loss of profit, resulting from the use or inability to use the Site and its contents, or site linked to it directly or indirectly, as well as omissions or errors. The Company shall not be liable for damages of any kind resulting from use of the Site, including any direct, indirect, incidental and consequential damages. The information on this Site may contain inaccuracies of typographical errors. The Company does not guarantee the accuracy of the information and is not responsible for any inaccuracies in the information; inaccuracies may include photographs, lists of hotel services, descriptions and general information. Publication of Users’ Contributions is subject to final approval by the Company. The Company takes no responsibility with regard to the apparent accuracy of the information and expertise, and all those pieces of information of primary and essential importance to allow the user of the Site to properly evaluate the services offered on the Site.

17. Separability

If any provision of the General Conditions is deemed unlawful, void, or for any reason unenforceable, that provision shall be deemed separable from other provisions, without affecting the validity and enforceability of any remaining provisions.

18. Governing Law

 These terms and conditions are subject to the Montenegrin law.

19. Law and jurisdiction

Considering all rights to which users should be entitled to under law – national or international – the General Conditions will be subject to Montenegrin law and shall be construed under the same (except for the rules on conflicts of law), including any dispute about the existence, validity and effectiveness of the General Conditions and any other related agreement refers for. Under Montenegrin law enforcement, in the event of any conflict of interpretation between the Italian, French, German, Spanish and Portuguese versions of the terms of use, the English version will prevail. Within what stated above, the jurisdiction to entertain any disputes arising in relation to the General Conditions and any other related agreement refers for, will be the one in Budva.

20. Changes to Terms and Conditions

The Company reserves the right to modify the Site and the current Terms and Conditions at any time. Changes will be posted on the Site and, subject to the right of withdrawal, the user shall continue to use the Site in accordance with the modified version of the General Conditions.

21. Additional Terms

Additional terms and conditions may be applied to the sale of goods and services or to the use of other parts of the Site: the user agrees to to comply with such other terms and conditions.
